Be it enacted by the Board of Trustees of the Village of Cayuga as follows:

LOCAL LAW NUMBER 1 OF THE YEAR 1975 FOR THE PURPOSE OF CONTROLLING DOGS IN THE VILLAGE OF CAYUGA, NEW YORK

Section 1: Title

This law shall be known as the "Dog Control Law of the Village of Cayuga, New York.

Section 2: Purpose

The purpose of said law shall be to preserve and protect the peace of mind, welfare, and property of all, persons residing in the Village of Cayuga by declaring and enforcing certain regulations, and restrictions on activities of dogs and owners of dogs within the village.

Section 3: Definitions
  1. Dog---Shall include both male and female dogs whether the latter be spayed or not.

  2. Owner---Any person who owns, keeps, harbors, or has the care, custody or control of a dog. Dogs owned by minors shall be deemed to be in the custody of the minor's parents, guardian or head of the household where the minor reside

  3. At Large---Any dog shall be considered at large when it is:

    1. Off the owners property.

    2. Undesirably on the property of another.

    3. Not under the restraint of a competant person.

  4. Restraint--- dog is to be considered under restraint when it is; as follows:

    1. It is controlled by a leash.

    2. It is in the presence of a competant person and obediant to that persons command.

    3. It is within the property limits of the owner whether loose or confined or on the premises of another with the consent of such person.

    4. On or within a vehicle being driven or parked on the street.

  5. Dangerous Dogs--Any dog which shall attack any person or domestic animal. within the meaning of Article 7 of the Agricultural and Markets Law of the state of New York shall be dealt with in accordance with Article 7 of the Agricultural and Markets Law.

  6. Nuisance Dogs ---Any dog which:

    1. Is habitually at large during any time of the night or day.

    2. Damages public property or which is habitually at large in any park or municipality-owned property.

    3. Habitually or seriously disturbs the peace and quiet of the neighborhood by barking, howling, or making or producing other noises.

    4. Habitually chases any person, bicycle, automobile, or other vehicle within the Village of Cayuga.

Section 4: Unlicensed Dogs

Pursuant to the provisions of Section 126a if the Agricultural and Markets Law of the State of New York; owning, keeping, or harboring a dog within the Village of Cayuga unless such dog is licensed as required by the provisions of the Agricultural and Markets Law shall be an offense punishable by a fine not to exceed ten dollars ($10.00) for each offense.

Section 5: Restrictions
  1. No owner shall permit or allow a dog to run loose in the Village of Cayuga in accordance with the above Section 3

  2. No unspayed female dog in season shall be allowed to roam nor shall she be left unattended without tine precaution of properly enclosing her either by fence or cage. In all cases she should be properly supervised so as to prevent the occurrance of packs of dogs.

  3. No owner shall harbor a dog which habitually howls or barks so as to disturb the peace and quiet of other persons.

  4. No owner of any dog shall allow such animal to become a Public Nuisance as defined in section 3, Article 6 above

  5. No owner of any dog shall allow it to run at large in any of the streets or public places within the village or upon the premises of any other person other than the owner or keeper unless the owner or occupant of such premises grants permission and no dog shall be permitted in any public place or street within the Village unless it be effectively attended by a person of adequate age and discretion to properly control its action.

Section 6: Dog Warden
  1. The position of Dog Warden or his duly authorized representative is hereby created who shall be appointed by the mayor with the approval of the Village Board of Trustees.

  2. Every dog seized by the Dog Warden shall be maintained redeemed, sold, or destroyed in accordance with Article 7 of the Agricultural and Markets Law of the State of New York.

Section 7: Penalties

A violation of this local law shall be deemed an offense against the within local law and shall be punishable by a fine not exceeding twenty-five dollars ($25.00) or by imprisonment not exceeding 10 days or by both such fine and imprisonment. Each separate occurance may constitute a separate additional violation. The penalties herein mentioned are in addition to the penalties restrictions and reguIations contained to Article seven of the Agricultural and Markets Law as now exists or may later be amended.

Section 8: Validity-Saving Clause

The validity of any clause, sentence paragraph or provision of this local law shall not invalidiate any other clause, sentence or paragraph or part thereof.

Section 9: Effective Date

This local law shall take effect upon adoption.
