This regular meeting of the Scipio Town Board was called to order at 7:30 p.m. on Wednesday, June 14, 2000 with the following members present:

MOTION: To accept the minutes of the previous regular meeting and the special meeting held May 30, 2000. (Phil Buckhout/Gary Goodnough). All in favor.

 

GUESTS: Jim Young, Town Supervisor of Fleming, expressed his appreciation of Scipio’s care of the Scipio-Fleming Town Line Road, and stated that at this time Fleming cannot appropriate money to maintain part of the road. He said that he understood that a verbal agreement at some time in the past had resulted in division of the responsibility for the road between Fleming and Scipio, but Fleming’s share is now cared for by the county.

Ann Mathieson read a letter of resignation from the Zoning Board of Appeals because she is moving outside of the town of Scipio. Supervisor Howell expressed thanks to Ann for her years of good service to the town.

 

COMMUNICATIONS: Supervisor Chuck Howell shared information about Nozzolio’s invitation to Kidspeace, County Planning Board Minutes, Chamber of Commerce brochures, Bishop Sheen’s housing grants, E-commerce Day in Albany, and Women Veterans’ Memorial dedication on September 9th at Emerson Park. He also reported that a request from Kennedy for a zoning variance has been denied, and that he received a letter from the Mathiesons stating that the shield over Culver’s light fell down, but has been reinstalled and for the moment is effective.

 

OLD BUSINESS:

 

RESOLUTION: To accept Local Law 1 for 2000 regarding telecommunications towers. (Howell/ Whitten). Opposed: Buckhout, Goodnough, Howell, Whitten. Abstained: Rury.

 

MOTION: To table this resolution until it is determined to what extent the town can restrict the level of noise emission. (Howell/Buckhout). All in favor.

 

Later in the meeting Attorney James Baier determined that the federal Telecommunications Act of 1996 states that “local government may not regulate personal wireless services on the basis of the environmental effects of radio frequency emissions as long as the facility complies with the

FCC’s regulations concerning such emissions.”

 

RESOLUTION: To adopt Local Law 1 for 2000 regarding construction and maintenance of telecommunications towers. (Howell/ Rury). All in favor.

 

Supervisor Howell reviewed the priorities of the board regarding the Cayuga Lake Watershed. Drinking water and water quality were high priorities.

 

BUILDING COMMITTEE: Phil Buckhout reported that he met with Gary Wood and he prepared a drawing, but it was not what the Board had directed. He recommended that we go ahead with the permissive referendum bond for financing with a high limit (estimated $280,000-300,000). Highway Superintendent Ron Walter agreed to check with the EPA regarding the feasibility of having a drain in the building.

 

HIGHWAY SUPERINTENDENT: Ron Walter reported that we should receive $38,740.74 in CHIPS money. Shipping date for the new grader is June 30th.
